Yes, I was wondering why Berkeley wasn't on there, but it was on last year's list. And last year's list is completely different than this year's, and the year before.
I would think that it would be better to make a list of colleges where the problem is consistent/persistent, rather than 1 incident. Or once you get on, you can't get off the list until you make improvements and can show why you should be removed.

What's wrong with University of the Cumberlands? I was looking at them as a potential school when I get ready to enter a Ph.D. program due to their price.

You'll likely be fine. University of the Cumberlands expelled an on-campus student for revealing on social media that he's gay. I don't think they're as strict with online students when it comes to enforcing their behavior rules.
Reading through the older articles, FIRE implies that Liberty and Brigham Young deserve to be on the list every year, but they don't put them on the list evey year because students know what they're getting themselves into, lol.

That’s absolutely insane that you can be expelled for being a gay student in America. It’s something we usually see happen in 3rd world countries. I don’t understand why anyone would want to attend such a disgusting university.

I believe schools should be able to do what they want with their own money; I just avoid them. But, University of the Cumberlands receives federal financial aid and millions from the State of Kentucky. The expulsion happened in 2006, but in 2016, University of the Cumberlands got a waiver that allows them to continue to discriminate against LGBTQ students and still receive federal financial aid. If you're not going to follow federal laws, then you shouldn't receive federal funds. There are gay people paying taxes that go to that school.

This is an interesting point. Schools(primary, secondary and post secondary) that are religious in nature sometimes receive federal money. This is something I will have to look more closely at.
