If the same credits are used to fill the AAS in ESS that would have been used for an AAS in CJ, I don't see how the ESS would make much of a difference besides having a misleading title.
As far as I know since Penn Foster only has NA accreditation, TESC will not accept any degrees awarded from it. Instead, it will only accept individual classes that are approved of by ACE (see their National Guide). This means that not all classes which are part of a PF degree would necessarily transfer to TESC. That to me would be the key so anyone is free to get an Associate's at PF and TESC in the same subject.
