It's reported that he never took a breathalyzer test, so we don't know what his BAC was at the time of his arrest.

Not giving legal advice, but if a cop ever asks you to do a field sobriety test, you're almost always going to be arrested regardless of the test results. So taking a field sobriety test usually only hurts you. Tony Romo didn't even know how to do the heel-to-toe walk in a straight line. So, in the words of Tony Romo, "Did I pass this test?"

And if Tony Romo had been driving a Tesla with FSD, this never would have happened. Just saying, lol.

Yes, we have some law students on this forum. I'm surprised we don't hear from them more often when legal cases come up. It would be interesting to see them speculate on how a case might play out.

There are a lot of people who have a drink or two, remain well under the legal limit, and could still be at risk of arrest if an officer decides to force a DUI case. It's very subjective because an officer can claim they "felt" you were impaired based on things like being nervous, talking too much or too little, or any number of other behaviors. It often starts with the reason you were pulled over in the first place. If you committed any traffic violation, they can claim it was caused by impairment. Once they decide to play that game, it's a game you can't win.

Some states, like Tennessee, have had hundreds of cases where police arrested drivers who later tested negative for both alcohol and drugs. In some instances, those drivers successfully sued and received settlements approaching six figures.

The police have that much power over you, where your car can be towed, you can be arrested, and your driver's license can be suspended for up to a year, all without you actually breaking the law.

The disclosure was made in connection with Romo’s no-contest plea to operating while intoxicated. Tony Romo is an adult, and there's really no excuse for being that reckless. At a .15 BAC, this wasn't a borderline case. He also has the financial means to have someone drive him or call for a ride, but he chose to drive himself.

At the same time, he's acknowledged what he did, taken responsibility, and is already facing serious consequences. America is a land of second chances. Hopefully he gets the help he needs, gets his life back on track, and eventually has an opportunity to move forward.
