Senator Mark Kelly and a Little - Told you so

SELF IMPOSED MINIMIZE CONSIDERED

++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++

Yesterday's "Administrative measures" punishment imposed on Sonenator Mark Kelly gave me a little flashback and a smile.

My honest thought is that the sly " Administrative measures" punishment was tadry.

The right way would have been to refer the matter to Court Martial.

I could not help but to remember this two decades old argument

Quote:I hate to burst Charles' bubble (and his nonsensical attack on me), but I am most certainly NOT subject to the UCMJ. Even active reservists are not subject to the UCMJ while they're between either training days or active duty sessions. As a retired reservist, I am under no one's command, including that idiot Bush. Were he to recall me to active duty, however, I would certainly cease public commentary about his inanities. But that isn't going to happen.

Rich Douglas, Nov 24, 2002

Well: Yes he was, and still is.

So is Senator  Kelly

Dan Lamothe and Tara Copp in the Spokane Spokesman-Review Wrote:Whether the case against Kelly will endure is another matter.

“None of this will stand up,” predicted Eugene Fidell, a senior research scholar and military law expert at Yale Law School. While a grade determination can be opened against a service member under narrow circumstances, he said, the actions under scrutiny must have occurred while someone was on active duty.

“This is dead on arrival as a grade determination,” Fidell said. “It’s free speech, it’s a free country, still, and there’s no ‘there’ there in terms of the power to reopen a retired grade.”

My point here is only to reiterate that retired military personnel are subject to the UCMJ.

I would rather see it enforced with due process.

That would also imply Mr. Hegseth is subject to the same actions too...

I hope all current and retired military are seeing this right now; quoting the UCMJ is violating the UCMJ apparently.

Rich is also correct, even back in 2002. UCMJ applies to federalized individuals under Title 10, whereas other individuals on Title 32, are state-controlled, even to include those who are AGR. For the most part, unless activated, Guardsmen and Reservists are exempt.

Let's say for some reason they were to, I can smell a sweet sweet lawsuit already baking in the oven to restore what was taken away.

Senator Kelley is a combat veteran, an astronaut, and his wife suffers a brain injury from a previous assassination attempt. Seems like an interesting choice for them to go after him and his well-deserved benefits given.

Kegs-breath didnt court martial him because he knew it would fail. It isnt about the rule of law. President Bone-Spurs got his little feelings hurt and lashed out.

I don't think so, because I do not think Pete Hegseth receives military retired pay.

True, but for Mr. Hegseth, he left (didn't retire) because he was flagged as an insider threat due to his tattoos being perceived as associated with extremist group(s).
