Resign before getting fired...

Just curious, what are the benefits of resigning before getting fired? Do they get a chance to get re-hired at a different school or something outside the city or county, even state? I would hate to see such a teacher evade charges or get re-hired elsewhere just because he knows loopholes in the educational system...

My daughter 12 goes to grade 6, she's fine, not bullied or anything, she's pretty good with everyone including teachers, but my son (10.5 years of age) in grade 5 is different, he needs extra help most of the time with a support teacher, he also gets bullied... I know how parents will feel when something like this happens, just sad...

There is unfortunately a huge range of variety in these situations. There is no unitary reporting system across the nation (assuming you are in the US, forgive if not) and often even within states. In most states, schools are mandated reporters, so at least there is usually a child welfare or services investigation opened. However, quite often they are quite slow and the teacher may be able to be hired by private schools or religious schools that have more leeway in their processes.

The only benefit is that you can say you weren’t terminated. I wasn’t able to open the link, so I don’t know the story, but if there are charges, then it should be picked up on a background check. When you work in schools, including private and religious schools, they do two background checks. One FBI and one BCI (state). In general, the HR person will get some sort of information about what came back. I don’t know if every state is the same, but we have to be re-checked every 5 years. The Catholic schools here also require Virtus training.

Many employment applications ask if you have ever been fired from a job. If you say yes, then you have to provide an explanation. Resigning in lieu of being fired allows you to truthfully avoid that situation.

Sometimes if they fire you, they will give you severance, where as if you quit they wont. Always make sure you have something lined up after either way.
