You need to do 16 credits in the flat-rate term, else you have to pay the waiver fee. Sixteen credits is both the maximum number of credits you can take (without needing extra permission) during a single term and the minimum number of credits necessary to avoid the waiver fee.
If you've got 15 credits, though, you could take one more 1-credit class for ~$500 instead of paying the waiver.
