I really don't think it's rude to the person sitting next to me, although I rarely am on my phone during class. By cell phone use I mean browsing the internet on my smart phone, not actively talking on the phone. Me browsing my phone with all the sounds turned off is about as distracting as me taking notes and turning pages in my notebook.
If they find it distracting because they are trying to see what I'm doing on my phone, then that is more of a personal problem of theirs than it is mine because they can actively choose what seat they sit in and they can choose to focus on the professor and not me.
