US Constitution Question - AngelaP - 08-11-2014

Is the below statement correct?

The U.S. Constitution has a specific section addressing the right to a clean and healthy environment.

Thanks for your help!

I am unaware of it. It is also unlikely, since it is a founding document that was compiled in a time when such issues were not as important. A statement which is used to postulate all sorts of ideas is the pursuit of happiness contained in the declaration of independence. Which isnt the constitution. You might find statements similar to the he one above in the UN rights of a child. Or the Un declaration of human rights

The closest the constitution gets to clean and healthy environment is the phrase "provide for the general welfare." I would argue that a clean and healthy environment is part of the general welfare of the country, but this is in the preamble and not a specific section.

Agreed, the constitution does not have a specific section that addresses this issue and that's why politicians, lobbyists, and environmentalists are always arguing whether these environmental laws/regulations supported by the constitution.

US Constitution Question - LaterBloomer - 08-12-2014

AngelaP, I'm not trying to be snarky, but read the Constitution. Even with the amendments, it isn't that long. At one point, I attended a paralegal school. The instructor, who had graduated from a top-tier law school, said that there wasn't anything in the Constitution about income tax. Hmmm, I thought. They taxed income during the Civil War. There was some sort of (?chief?) justice on the Supreme Court who always shot down the consitutionality of income tax when it reached the Court. He died. An amendement was passed. It would have had to be post-Civil War. Sure 'nuf, I found it and pointed it out to the instructor. Now, I'd bet good money that all lawyers have to take a Constitutional law course. Somehow, he managed to take the course without reading (or rememebering) the Sixteenth Amendment. It was amazing. He didn't say anything.

Thanks everyone. I think it is incorrect also. That statement was on an ungraded quiz I took with SL's Intro to Environ. Science. I have submitted many errors to them relating to this class. It has been a real pain. Glad to be done with it today!

I did read it and all the amendments. I just wasn't sure if I was missing something or not. I don't come here looking for an easy answer.

Asking the question here serves no purpose. Forum feedback does not change your grade or help update/correct SL's test bank software. Which is why I think all students who take the courses and find problems should file disputes.

I had the same problem with SL, especially with my accounting course. Filing a dispute was very easy:

Simply copy and paste the question with incorrect answer into a word doc. Note it was in fact the correct answer, provide the textbook page as proof, and send to the course advisor. After investigating he/she will respond to your inquiry and if proven correct, will adjust your grade on exams/midterm/final.

Geez, get up on the wrong side? I am pretty surprised by your input here as you are usually not like this. As stated it was ungraded, SL has made corrections to the errors I have submitted, and I did everything you said yesterday and several days before that with other errors. I was just curious to others feedback as no where in the book does it even mention the US Constitution. It did serve a purpose to ask on here for me whether you agree or not.

I apologize if I sounded rude. Did not mean to come off that way but was being honest. The two questions you posed to the board were interpretation or easy to answer via google. Most are not enrolled so how could they even give an opinion that would prove useful to you or the next student.

Again, it does not matter what we think it is SL's gross test bank errors, which is where my true grievance lies. They do not review their exams before publishing them. It is a pain in the neck that can only be corrected by students filing disputes in hopes of making it easier for the next person.

Sorry to come of brash, my demeanor was/is not directed at you. The advice on how to file a dispute was for all members/guests reading the thread. Straighterline courses is one of my pet peeves in this regard.

Take care!
